Why it matters (compliance & governance perspective)

This provision establishes the scope and mechanism of consumer opt-out rights, including the specific clarification that profiling for legal or significant effects is not offered as an opt-out option because Experian asserts it does not engage in such profiling. The document's note that opt-out settings are linked to current address means that consumers who relocate may need to resubmit requests, creating an ongoing maintenance obligation for consumers who want their opt-out to remain effective.

Consumer impact (what this means for users)

Under this provision, consumers may opt out of personal information sales, sharing, and targeted advertising without identity verification through multiple channels including online, phone, mail, and email. The notice states that opt-out settings are linked to current address and that consumers who change addresses may need to resubmit their opt-out request.

You have the right to opt out from the sale/sharing of personal information, use of personal information for targeted advertising, and profiling that produces a legal or similarly significant effects. Because Experian does not engage in profiling in furtherance of a decision that produces legal or similarly significant effects within the meaning of U.S. state privacy laws, Experian does not offer this as an opt out option. In certain states, opting out also includes your right to limit the use and disclosure of sensitive personal information. This is not related to your credit report and will not affect your credit score.

ConductAtlas Analysis

Institutional analysis (regulatory & governance intelligence)

1. REGULATORY LANDSCAPE: This provision implements opt-out requirements under the CCPA, CPRA, and multiple state privacy statutes. The CPRA is enforced by the California Privacy Protection Agency. The right to limit sensitive personal information use referenced in the provision is a CPRA-specific mechanism. The FTC may evaluate the adequacy of opt-out mechanisms under its Section 5 authority and its regulatory guidance on data broker practices. 2. GOVERNANCE EXPOSURE: Medium. The address-linkage of opt-out settings creates a procedural gap for consumers who relocate, and the adequacy of this mechanism may be evaluated by regulators assessing whether opt-outs are honored in a durable and persistent manner. The exclusion of profiling for significant effects as an opt-out option because Experian self-certifies non-engagement is an assertion that compliance teams at client organizations should note. 3. JURISDICTION FLAGS: California residents have the most robust set of rights under this provision, including the right to limit sensitive personal information use. Texas residents benefit from data broker registration requirements. Consumers in states not covered by the listed privacy statutes may have more limited opt-out rights under this framework. 4. CONTRACT AND VENDOR IMPLICATIONS: Institutional clients who share consumer data with Experian or receive data products from Experian should evaluate whether their agreements address how opt-out signals received by Experian are communicated downstream and whether data products exclude opted-out consumers. The Global Privacy Control acceptance provision may affect the volume and handling of opt-out signals for digital marketing clients. 5. COMPLIANCE CONSIDERATIONS: Compliance teams should audit whether the opt-out portal at consumerprivacy.experian.com correctly processes requests across all personal information and sensitive personal information categories listed in the notice. The address-linkage mechanism should be evaluated for consistency with state law requirements for durable opt-out. The processing of Global Privacy Control signals should be tested to confirm that browser-level opt-outs are honored across all digital properties covered by the notice.
