The updated terms establish a new regulatory framework for Digital Agents (AI and automated software) accessing Best Buy's website and services. Users who authorize Digital Agents must ensure they identify themselves in HTTP requests, comply with Best Buy's published guidelines, and operate transparently without mimicking human behavior or circumventing security mechanisms like CAPTCHAs. Best Buy reserves the right to limit, restrict, suspend, block, or ban any Digital Agent at its sole discretion for any or no reason and with or without notice. Additionally, the revised arbitration procedures now require dispute notices to be personally signed by the initiating party and their counsel (if represented), include specific documentation such as purchase receipts and interaction details, and be filed through JAMS rather than AAA. These changes materially alter how disputes are initiated and processed, imposing stricter procedural requirements before arbitration can commence.
