What it is

Anyscale limits what it has to pay you if something goes wrong to the amount you paid them in the last year, or $100 — whichever is more. You cannot recover lost profits or other indirect damages.

This analysis describes what Anyscale's agreement states, permits, or reserves. It does not constitute a legal determination about enforceability. Regulatory applicability and practical outcomes may vary by jurisdiction, enforcement context, and individual circumstances. Read our methodology

ConductAtlas Analysis

Why it matters (compliance & governance perspective)

For businesses running critical AI workloads on Anyscale, a platform failure or data loss could cause damages far exceeding the fees paid, but this clause caps Anyscale's financial responsibility at a potentially very low amount.

Consumer impact (what this means for users)

If Anyscale's platform fails and causes significant business losses — such as lost AI training data, delayed product launches, or downstream revenue harm — users can only recover at most what they paid Anyscale in the prior year, which may be a fraction of the actual damage suffered.

Institutional analysis (Compliance & governance intelligence)

(1) REGULATORY FRAMEWORK: Limitation of liability clauses are governed by state contract law (California Civil Code §1668 prohibits exemption from willful misconduct liability); UCC Article 2; and may be constrained by GDPR Art. 82 (which establishes data subject rights to compensation that cannot be contractually waived). EU consumer protection law (Directive 93/13/EEC) may render liability caps unenforceable against EU consumers for personal data harms. (2)
