What it is

Generated by a model from the captured document; not read by a person

For users outside the EU/EFTA/UK, all disputes must be brought exclusively in Texas courts (Wichita County or Tarrant County) under Texas law, with a fallback to binding AAA arbitration before a retired federal judge if the Texas venue clause is found unenforceable. The arbitration is conducted in English in Tarrant County, Texas, with each party bearing its own costs unless the arbitrator determines claims were frivolous.

Why it matters (compliance & governance perspective)

Generated by a model from the captured document; not read by a person

This provision establishes exclusive Texas venue and Texas governing law for all disputes for non-EU/UK users, including disputes arising from content, account termination, and patent claims. The arbitration fallback, which was newly introduced in the October 9, 2026 version of the terms, requires arbitration to be administered by the AAA before a retired federal judge if the primary forum selection clause is unenforceable, with the arbitrator prohibited from granting injunctive relief and the award final and binding with waived appeal rights.

If You Do Nothing

⚠ Disputes arising after October 9, 2026 will proceed under Texas law and exclusive Texas venue or AAA arbitration as stated in the terms if no action is taken to contest the agreement

⚠ The arbitration award, if arbitration is invoked, is stated to be final and binding with waived appeal rights to the maximum extent permitted by law
