The most important thing to know is that by default, everything you type into the Chat feature — including your code and prompts — is used to train Windsurf's AI models, and opting out means you permanently lose access to the Chat service. If you pay for a subscription, it auto-renews and all fees are non-refundable, so you must cancel before your renewal date to avoid being charged.

If you have a dispute with Windsurf, you cannot sue them in court or join a class action lawsuit — you must resolve it through private arbitration on your own, one-on-one.
Windsurf uses everything you type into the Chat feature — your code, questions, and prompts — to train its AI models. If you want to stop this, you lose access to the Chat feature entirely.
Your Windsurf subscription renews automatically and charges you for the next full period if you don't cancel before the renewal date — and once charged, fees are not refunded.
If your credit card expires or is declined when your subscription renews, Windsurf can permanently delete your account and all your data with no obligation to notify you or compensate you.
If you ever suggest improvements or report issues to Windsurf, they own those ideas forever and can use them for any purpose — for free, with no credit to you.
Code you write using Windsurf's autocomplete feature is used to train Windsurf's AI ranking models, but you can opt out in settings without losing the autocomplete feature — unlike Chat.
If you pay for a Pro subscription, you can enable a Zero Data Retention mode where your code is processed in real-time, deleted immediately after a response is generated, and never stored or used for training.
Windsurf collects data about how you use the platform — not your code itself, but behavioral and performance data — and owns it outright, including any new products or insights derived from it.
Windsurf can monitor, record, and copy anything you transmit through their service at any time, but claims no responsibility for the content they monitor.
Windsurf requires users to be at least 13 years old, but relies on users' own representations rather than age verification — meaning there is no technical barrier to younger children accessing the service.
