What it is

The policy states that TikTok receives behavioral data from external advertisers and partners, including off-platform browsing, purchase history, and app downloads, and uses this data alongside mobile advertising identifiers and hashed contact information to deliver targeted advertising both on TikTok and through the TikTok Ad Network on third-party platforms.

This analysis describes what TikTok's agreement states, permits, or reserves. It does not constitute a legal determination about enforceability. Regulatory applicability and practical outcomes may vary by jurisdiction, enforcement context, and individual circumstances. Read our methodology

Advertisers, publishers, and measurement and other partners provide us with information about you and the actions you have taken outside of our websites and apps, including the pages you visit, products or services you purchase, and apps you download. These partners also provide information such as mobile identifiers for advertising, hashed email addresses and phone numbers, and cookie identifiers, which we use to help measure the effectiveness of ads we serve and to better deliver ads to you on our websites and apps, or through TikTok Ad Network elsewhere online, depending on your ads settings.

ConductAtlas Analysis

Institutional analysis (regulatory & governance intelligence)

(1) REGULATORY LANDSCAPE: The receipt and use of off-platform behavioral data for ad targeting engages CCPA opt-out rights for cross-context behavioral advertising, FTC oversight of data broker and advertising data practices, and state-level data broker registration requirements. Hashed email and phone number ingestion from partners may implicate identity resolution practices subject to FTC scrutiny. (2) GOVERNANCE EXPOSURE: High. The combination of on-platform data with off-platform partner data for cross-platform ad delivery creates a broad behavioral advertising infrastructure. The reference to Executive Order 14352 compliance obligations in the data sharing section suggests this infrastructure is subject to federal data governance constraints. (3) JURISDICTION FLAGS: California CCPA provides opt-out rights for cross-context behavioral advertising. Connecticut, Colorado, Virginia, and Texas privacy laws include analogous opt-out rights. Non-account holders in these states may have limited ability to exercise rights through the available webform mechanism. (4) CONTRACT AND VENDOR IMPLICATIONS: Publishers and advertisers integrating TikTok Pixel or TikTok Advertiser Tools should assess whether their privacy notices adequately disclose data flows to TikTok, and whether data sharing with TikTok for advertising purposes triggers opt-out or consent obligations under applicable law. (5) COMPLIANCE CONSIDERATIONS: The policy provides an in-app Ads settings path for account holders and a webform for non-account holders to manage TikTok Ad Network targeting. Compliance teams should verify that these mechanisms meet the opt-out functionality standards required under applicable state privacy laws, including whether the webform constitutes a valid universal opt-out mechanism.
