Certain countries or jurisdictions may impose regulatory constraints on giveaways. If you run a giveaway, you are solely responsible for complying with applicable law. You explicitly acknowledge that Telegram is not liable in the event of sanctions, fees, and any form of legal or administrative action incurred as a result of or in relation to your use of the "Giveaway" feature provided by Telegram. Channel admins can use the Giveaway feature to announce arbitrary prizes in addition to premium subscriptions. Should they choose to do so, they are solely responsible for delivering said prizes to giveaway winners. Telegram will not be liable if any disputes arise in relation to the prizes, their delivery or lack thereof.

ConductAtlas Analysis

Institutional analysis (regulatory & governance intelligence)

(1) REGULATORY LANDSCAPE: Giveaways and prize promotions are regulated in most jurisdictions, including under FTC guidelines in the US, the UK Gambling Commission's rules on prize competitions, and various EU national gambling and promotional laws. Channel operators who conduct giveaways with monetary value may trigger lottery, sweepstakes, or promotional contest regulations that vary significantly by jurisdiction. (2) GOVERNANCE EXPOSURE: High for channel operators. The blanket liability disclaimer for regulatory sanctions, fees, and legal actions incurred from giveaway use places substantial compliance responsibility on individual channel administrators, who may not have the legal resources to assess multi-jurisdictional compliance. (3) JURISDICTION FLAGS: US federal and state sweepstakes laws, UK Gambling Act provisions, and EU member state promotional regulations all create a complex compliance landscape. The document acknowledges jurisdictional variance but provides no compliance guidance. (4) CONTRACT AND VENDOR IMPLICATIONS: Organizations using Telegram channels for marketing giveaways should conduct legal review of applicable promotional law in each target jurisdiction before activating this feature, given the explicit liability disclaimer in the terms. (5) COMPLIANCE CONSIDERATIONS: Marketing and legal teams should assess whether their intended giveaway structure complies with applicable sweepstakes, lottery, and promotional law in each relevant jurisdiction prior to use. The nonrefundable purchase structure for giveaway subscriptions should be factored into campaign planning.
