The Multi-Model Addendum governs use of Tabnine's platform integrated with third-party AI models via API or model-switching functionality, subjecting users to both the Addendum terms and the third-party model owner's published terms at the time of use.
This analysis describes what Tabnine's agreement states, permits, or reserves. It does not constitute a legal determination about enforceability. Regulatory applicability and practical outcomes may vary by jurisdiction, enforcement context, and individual circumstances. Read our methodology
This provision establishes that use of third-party AI models through Tabnine introduces an additional contractual layer governed by the terms of the third-party model owner, creating data flow and liability dependencies that may not be fully visible to the user at the time of model selection.
Interpretive note: The specific third-party model owners and their terms are not enumerated in the document excerpt provided, meaning the full scope of obligations under this Addendum depends on which models are available and what terms those owners publish at the time of use.
Under this clause, users who elect to use third-party AI models via Tabnine's platform are bound by the terms published by the third-party model owner at the time of use, in addition to Tabnine's own terms. The specific terms applicable will depend on which third-party model is selected and the terms in effect at that time.

(1) REGULATORY LANDSCAPE: The use of third-party AI models integrated into a developer platform may engage the EU AI Act depending on the classification of those models and the role of Tabnine as deployer or integrator. GDPR data processing obligations apply to any personal data processed by third-party models through this integration, potentially requiring data processing agreements with each model provider. Export control law may apply depending on the country of origin of third-party models. (2) GOVERNANCE EXPOSURE: Medium. The clause creates a dynamic contractual dependency where the applicable terms for third-party model use are those published by the model owner at the time of use, which may change without advance notice to Tabnine or the user. This creates ongoing compliance monitoring obligations for enterprise customers using model-switching functionality. (3) JURISDICTION FLAGS: EU-based organizations must assess whether third-party model providers processing data through Tabnine integrations are GDPR-compliant data processors, and whether data transfer mechanisms are in place for any cross-border data flows. The EU AI Act's obligations on deployers of AI systems are relevant where enterprise customers use third-party models in production development environments. (4) CONTRACT AND VENDOR IMPLICATIONS: Enterprise procurement teams should identify which third-party models are available through Tabnine's platform, review the terms published by each model owner, and assess data processing, IP, and liability implications before enabling model-switching functionality for organizational users. (5) COMPLIANCE CONSIDERATIONS: Organizations should implement governance policies specifying which third-party models within Tabnine are approved for use, maintain awareness of changes to third-party model terms, and assess whether each approved model's data handling practices are consistent with organizational data governance requirements and applicable regulatory obligations.
