What it is

By posting content on Pinterest, users grant Pinterest, its affiliates, service providers, and other users a worldwide, royalty-free, sublicensable license to use, modify, monetize, and distribute that content, with no entitlement to payment or revenue share from any such monetization.

This analysis describes what Pinterest's agreement states, permits, or reserves. It does not constitute a legal determination about enforceability. Regulatory applicability and practical outcomes may vary by jurisdiction, enforcement context, and individual circumstances. Read our methodology

ConductAtlas Analysis

Why it matters (compliance & governance perspective)

This provision establishes the contractual basis under which Pinterest may commercially exploit User Content without compensation to the posting user. The license is transferable and sublicensable, meaning it may be passed to third parties, and it persists beyond account deletion for content already shared by others, as addressed in Section 3(c).

By providing any User Content on the Service, you grant us and our affiliates and service providers, and our users, a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, publicly perform or display, reproduce, save, modify, create derivative works, monetize, download, translate and distribute your User Content, including for the purpose of promoting and redistributing part or all of the Pinterest Service. Nothing in these Terms: (i) entitles you to any payments or the right to share in any revenue from any monetization of User Content; or (ii) restricts other legal rights we may have to User Content, for example under other licenses.

ConductAtlas Analysis

Institutional analysis (regulatory & governance intelligence)

1. REGULATORY LANDSCAPE: This provision may engage GDPR where User Content contains personal data and monetization constitutes processing for commercial purposes beyond the user's original intent, implicating lawful basis and purpose limitation requirements enforced by the Irish Data Protection Commission for EU/EEA users. EU moral rights frameworks applicable in several member states may also be relevant where the license authorizes modification or derivative works. FTC endorsement guidelines apply where User Content is commercially repurposed in advertising contexts. 2. GOVERNANCE EXPOSURE: High. The combination of a royalty-free, sublicensable, worldwide monetization license with an explicit no-compensation clause creates material exposure for content creators who may not anticipate commercial use of their posts. The sublicensable nature of the license means third-party commercial use is authorized without additional user consent. 3. JURISDICTION FLAGS: EU and EEA member states with strong moral rights protections (including France and Germany) may limit the enforceability of derivative works and modification rights asserted in this license. California's right of publicity laws may interact with the monetization license where User Content includes identifiable individuals. The provision applies globally but is subject to local law limitations not addressed in the Terms. 4. CONTRACT AND VENDOR IMPLICATIONS: Organizations that permit employees or contractors to post business-related content on Pinterest should assess whether this license creates unintended IP transfers. The sublicensable nature of the grant may require evaluation in vendor agreements where proprietary content could be posted by users acting on behalf of an entity. 5. COMPLIANCE CONSIDERATIONS: Compliance teams should review whether the monetization license, combined with the incorporated Privacy Policy's data use disclosures, satisfies GDPR transparency and lawful basis requirements for EU users. Data mapping exercises should account for User Content processed under this license as a distinct category from account data. Creator-facing disclosures may warrant review against FTC guidance on commercial content.
