Unilateral Fee Modification Rights

Medium severity
Share 𝕏 Share in Share 🔒 PDF

What it is

Patreon can change how much it charges creators or patrons at any time. If you keep using the service after they announce a change, they consider that your agreement to the new fees.

Consumer impact (what this means for users)

Patreon can increase the fees it charges to creators — reducing the percentage of patron payments creators actually receive — simply by providing notice, meaning creators have no contractual protection against fee increases without abandoning their entire patron community.

What you can do

⚠️ These actions may provide transparency or partial mitigation but may not fully address the underlying issue. Effectiveness varies by jurisdiction and individual circumstances.
  • Cancel Subscription
If you disagree with a fee change, log into your Patreon account, go to Settings, and cancel or close your account before the new fee structure takes effect. Download your data and notify your patrons before doing so.

Why it matters (compliance & risk perspective)

Creators who have built their pricing and patron expectations around specific Patreon fee structures may find their net earnings reduced without any ability to negotiate, with the only recourse being to leave the platform.

View original clause language
Patreon reserves the right to change its fees and fee structure at any time. We will provide notice of fee changes, but your continued use of the service after notice constitutes acceptance of the new fees.

Institutional analysis (Compliance & legal intelligence)

REGULATORY FRAMEWORK: This provision engages FTC Act Section 5 (unfair or deceptive acts) in the context of whether 'notice plus continued use' constitutes valid informed consent to fee increases, particularly for users who may not actively monitor policy update emails. State contract law doctrines on illusory contracts and unconscionability are relevant — courts in several jurisdictions have declined to enforce unilateral modification clauses where the modifying party bears no corresponding obligation. California Business & Professions Code §17200 (UCL) may apply to fee changes that are not adequately disclosed.
