Patreon collects tax identification information from creators and reports earnings to tax authorities as required by law, including issuing Form 1099-K to U.S. creators meeting applicable thresholds. Creators who fail to provide accurate and current tax identification information may have taxes withheld from their payments, and amounts withheld and remitted are treated as having been paid to the creator with no entitlement to additional payment.

This provision establishes that withheld tax amounts are treated as constructively paid to the creator, eliminating any claim for additional payment in respect of the withheld sum. Incomplete or inaccurate tax information triggers withholding authority and may interact with fund withholding provisions to reduce creator disbursements.
Under this clause, creators who do not provide accurate tax identification information may have taxes withheld from their Patreon earnings, and those withheld amounts are treated as having been received by the creator under the terms, with no entitlement to additional payment. U.S. creators meeting applicable thresholds will receive IRS Form 1099-K, and Patreon may report earnings to non-U.S. tax authorities as required.

"In order to satisfy our tax obligations, we collect tax identification information and, in certain circumstances, report this information and earnings to tax authorities as legally required. For example, if you are located in the United States or are a United States citizen who has earnings reaching certain thresholds, Patreon is required to issue you a Form 1099-K at year end. Furthermore, Patreon may be obligated to report certain information to jurisdictions outside of the United States. You must provide accurate and current tax identification and status information where appropriate, and update said information in the event of a change. If you fail to provide such information, or if it is incomplete or inaccurate, Patreon may withhold taxes from payments to you as required by applicable law. Any amounts withheld and remitted to the relevant tax authority will be treated as having been paid to you, and you will not be entitled to any additional payment in respect of such withholding.Excerpt from Patreon's Terms of Use
(1) REGULATORY LANDSCAPE: This provision directly engages IRS Form 1099-K reporting requirements under U.S. tax law, which apply to payment settlement entities reporting third-party network transactions above applicable thresholds. International VAT, GST, and local service tax obligations are addressed separately in the document. The constructive receipt treatment of withheld amounts reflects standard U.S. tax withholding principles but should be evaluated by creators' tax advisors in their specific circumstances. (2) GOVERNANCE EXPOSURE: Medium. The constructive receipt clause eliminates creator entitlement to additional payment for withheld amounts, which may affect creators' cash flow and tax planning if withholding is applied due to documentation deficiencies rather than actual tax liability. (3) JURISDICTION FLAGS: U.S. creators are subject to Form 1099-K reporting obligations. Non-U.S. creators may be subject to reporting obligations in their home jurisdictions under information exchange agreements. Creators in jurisdictions with tax treaty arrangements with the U.S. must provide documentation of treaty entitlement to claim reduced withholding as stated in the document. (4) CONTRACT AND VENDOR IMPLICATIONS: Business accounts operating creator pages should ensure tax identification information on file with Patreon is current and accurate to avoid triggering backup withholding. Institutional creators managing multiple accounts should implement a process for tax information currency review. (5) COMPLIANCE CONSIDERATIONS: Tax and legal teams should advise creators to maintain current W-9 or W-8 series forms as applicable on the Patreon platform and to review Form 1099-K issuance for consistency with actual earnings records.
