ConductAtlas Analysis

Why it matters (compliance & governance perspective)

This provision establishes a present, automatic assignment of all intellectual property rights in any user submission to Nintendo, including rights to unrestricted commercial use without compensation. The clause also requires users to execute future documentation at Nintendo's sole discretion to confirm the assignment, creating an ongoing contractual obligation.

Interpretive note: The clause's application to submissions made 'otherwise' than through the Services creates ambiguity about geographic and contextual scope; enforceability of the future documentation obligation may vary by jurisdiction.
