This is the Terms of Service for Leonardo.Ai, the generative AI platform that lets you create images and videos using artificial intelligence. The most important thing to know is that Leonardo.Ai can use the images and prompts you create on the platform to train its AI models — unless you specifically opt out of this in your account settings. If you want to stop your content being used for AI training, check your account privacy settings and adjust them before generating any content.
Technical Summary
This document governs the contractual relationship between Leonardo Interactive Pty Ltd T/A Leonardo.Ai (ACN 662 209 485), an Australian entity, and users of its cloud-based generative AI image and video creation platform, with the agreement operative from account sign-up until termination. The most significant user obligations include compliance with usage policies prohibiting harmful/illegal content generation, restrictions on reverse engineering the platform, and acceptance that Leonardo.Ai may use user-submitted inputs and outputs to train its AI models unless users opt out. Notable deviations from industry standard include a broad licence grant to Leonardo.Ai over user content including AI-generated outputs for platform improvement purposes, explicit disclaimers that AI outputs may not be accurate or free from third-party IP infringement, and a limitation of liability that caps Leonardo.Ai's exposure to fees paid in the prior 12 months. The document engages Australian Consumer Law (ACL) under the Competition and Consumer Act 2010, GDPR (for EU users), CCPA (for California residents), and COPPA/equivalent age-gating requirements given the 13-year minimum age threshold. Material compliance considerations include the AI training data licence (potentially implicating EU AI Act obligations), cross-border data transfer mechanisms referenced in the linked Data Processing Addendum, and the platform's explicit disclaimer of warranties regarding IP ownership of AI-generated outputs.
Leonardo.Ai can use the prompts you type and the images or videos it generates for you to train and improve its AI. You can turn this off in your account settings.
Leonardo.Ai does not guarantee that the images or videos it generates for you are free from copyright or other IP claims. If someone sues you over an AI-generated image, that is your problem, not Leonardo.Ai's.
Leonardo.Ai limits how much money it can owe you if something goes wrong — typically capped at what you paid in the last 12 months. This means if AI outputs cause you significant loss, Leonardo.Ai's financial responsibility is strictly limited.
Leonardo.Ai can change the rules of your agreement at any time. If you keep using the platform after they notify you (or after 30 days, whichever comes first), you automatically agree to the new terms.
Leonardo.Ai subscriptions automatically renew unless you cancel before the renewal date. Make sure you cancel in advance if you do not want to be charged for the next period.
You must be at least 13 to use Leonardo.Ai. If you are under 18, a parent or guardian must have given permission. Different countries may require a higher minimum age.
Leonardo.Ai gives you a limited, temporary licence to use its platform — this is not ownership of any software or technology. The licence ends when your account is terminated.
Leonardo.Ai can suspend or close your account, potentially without warning. If this happens, you lose access to the platform and any content stored there.
If you connect other tools or services to Leonardo.Ai, the company is not responsible for anything that goes wrong with those third-party products — you take on that risk yourself.
Leonardo.Ai handles your personal data and any confidential information you share according to its privacy policy and data processing addendum, which are separate documents from these Terms.
