ConductAtlas Analysis

Institutional analysis (regulatory & governance intelligence)

REGULATORY LANDSCAPE: This provision is primarily a contractual intellectual property and acceptable use restriction rather than a regulatory compliance mechanism. It interacts with copyright law regarding the use of platform-derived data for model training, an area of active litigation and regulatory development in the US and EU. The EU AI Act's provisions on training data transparency and data governance may interact with this restriction for AI developers operating in EEA jurisdictions. GOVERNANCE EXPOSURE: Medium. The breadth of the definition of AI Technology and the inclusion of anonymized or aggregated data in the prohibition is operationally significant for any developer, researcher, or third party that accesses or scrapes Grindr platform data. Enforcement would depend on Grindr's ability to detect such use, which the agreement does not specify. JURISDICTION FLAGS: The restriction applies globally as written, but its enforceability against users in jurisdictions with fair use, fair dealing, or research exemptions under copyright law may be limited. EU users engaged in scientific research or journalism may have statutory rights that interact with this contractual restriction. CONTRACT AND VENDOR IMPLICATIONS: Organizations that develop AI products and access Grindr data through any means should assess whether their data pipelines or model training workflows could be construed as violating this provision. The prohibition on anonymization and aggregation for AI purposes is broader than typical platform terms and may affect academic research and third-party analytics use cases. COMPLIANCE CONSIDERATIONS: Legal teams at AI development organizations should review data sourcing documentation to confirm that Grindr platform data, including any data acquired through third-party data brokers or scraping, is not included in training datasets. The provision's inclusion of indirect use and aggregated data means that standard data anonymization workflows do not provide a safe harbor under these terms.
