If you have a dispute with Fitbit, you must resolve it through individual binding arbitration rather than going to court, and you cannot join or lead a class action lawsuit against the company.
Fitbit limits its financial responsibility to you in the event something goes wrong — typically capping damages at the amount you paid for the service or a small fixed amount, excluding indirect or consequential losses.
Fitbit collects sensitive health data including heart rate, sleep patterns, activity levels, and other biometric information through your device and app usage.
When you submit or upload content to Fitbit's services, you grant Fitbit a broad license to use, reproduce, modify, and distribute that content for the purposes of operating and improving their services.
Fitbit reserves the right to suspend or terminate your account at any time, including for violations of their terms or at their sole discretion, potentially without prior notice.
Fitbit can change these Terms of Service at any time, and your continued use of their services after changes are posted constitutes your acceptance of the new terms.
Fitbit retains all intellectual property rights in their devices, software, and services. You are granted a limited, non-exclusive license to use their products for personal, non-commercial purposes only.
