The updated terms require all disputes to be resolved through binding individual arbitration rather than court litigation or class actions. The agreement explicitly states that users are giving up the right to sue in court, participate in class actions, and have access to a judge or jury, with arbitration discovery and appeal rights being more limited than court proceedings. Users have a limited-time right to opt out of this requirement, which is detailed in Section 18 of the Dispute Resolution terms. The explicit disclosure that AI outputs may contain hallucinations is a transparency measure, but the complete allocation of verification responsibility to users may face scrutiny in consumer protection contexts, particularly for safety-adjacent applications such as home security. 3. JURISDICTION FLAGS: EU AI Act compliance requirements create heightened exposure for AI features deployed in consumer-facing devices in the EU. The disclaimer's interaction with EU product liability frameworks, including the proposed revised EU Product Liability Directive, warrants monitoring. California, Illinois, and other US states with AI-related disclosure laws may impose additional obligations.
