5901Select Sellers can create and schedule Posh Shows, as well as join other Sellers’ Posh Shows as co-hosts (collectively, “ Hosts ”).
5902Poshmark has sole discretion to determine user eligibility to host or participate in Posh Shows.
5903As set forth in our Terms of Service , you are solely responsible for any activity that occurs through your Poshmark account and all content you transmit or submit through Poshmark, including any live content from Posh Shows.
5904Auctions During a Posh Show, the Host may choose to start an auction.
5905Whether you are a Buyer or a Seller, when you participate in an auction, you understand and agree as follows: Sellers set the starting price.
5906If you are a Seller, please be sure to set the starting price that reflects a comfortable sale price for you.
5907Once an auction has started, it cannot be canceled, and the starting price cannot be adjusted.
5908Sellers are not permitted to bid on their own item or to ask others to bid up the prices on an item.
5909All bids are final and binding.
5910If you are the highest bidder when an auction concludes, your payment method will be charged for the winning bid amount, plus any shipping, taxes, or additional fees listed.
5911Please note: There may be instances in which two users enter the same bid amount at nearly the same time.
5912In this case, if your username is not displayed as the highest bidder, then your bid was not accepted, and you will need to submit a new, higher bid if you would like the item.
5913Poshmark is not responsible for technical issues, including disconnection from the platform, while buying or selling.
5914Bids entered and accepted prior to a loss of connection will be considered binding.
5915Buy Now Hosts may enable Buy Now on certain listings during a Posh Show.
5916Once Buy Now is enabled, Buyers will be able to purchase the featured listing directly in the Posh Show at the price indicated.
5917Buy Now will be enabled until the listing is sold out, or until the host stops Buy Now or features another listing.
5918All Buy Now purchases in a Posh Show are final and binding.
5919Promotions As a Host, if you choose to use the Service to administer or communicate a promotion (i.e. sweepstakes or contest) during a Posh Show, you are responsible for the operation of that promotion in accordance with our Terms of Service , our Privacy Policy , and any applicable laws, including the following: Offer terms and eligibility requirements (e.g. age and residency) Official rules that include all disclosures required by applicable laws and regulations and that include: A complete release of Poshmark by each entrant or participant; and A statement acknowledging that the promotion is in no way associated with or sponsored, enforced, or administered by Poshmark; and Compliant with applicable laws and regulations governing the promotion and the prizes (e.g. registration requirements).
5920Poshmark will not assist in the administration of giveaways offered outside of the "Giveaways" feature (each, a "Giveaway"), and you agree that if you use the Service to administer your promotion, you do so at your own risk.
5921Where Host(s) conducts a sweepstakes as part of a Posh Show, the following additionally applies: Prizes offered for a chance to win and randomly awarded via the "Giveaways" feature will not be considered by Poshmark to have a cash value and are not considered purchases, and any transaction(s) that consist of such item(s) are not eligible for refund via Posh Protect .
5922Hosts and prize winners are responsible for the reporting and payment of any and all prize related taxes and expenses, respectively, where applicable.
5923Prizes offered via the "Giveaways" feature must adhere to selling guidelines .
5924Host(s) are not allowed to give away prohibited or otherwise unsupported items , such as replicas, perfume, nail polish, or non-Poshmark gift cards.
5925Poshmark gift card prizes cannot be used for purchases made within the same Posh Show and hold no cash value.
5926All Poshmark gift card prizes, whether a physical gift card or a printed version of a virtual gift card, must be shipped to the winner using Poshmark’s provided shipping label.
5927The listing for the Giveaways prize must be categorized appropriately (e.g., if the prize is an electronics item, the listing must be categorized as such).
5928Hosts are responsible for the costs of shipping Giveaway prize(s).
5929Shipping costs will be automatically deducted from the Host's earnings.
5930Any additional items purchased by the Giveaway winner during the same Posh Show will be bundled and shipped with the Giveaway prize(s).
5931If the total weight of the bundle (including the Giveaway prize(s)) is over 5 pounds, the Host must pay to upgrade the shipping label.
5932Hosts must use the Poshmark-provided shipping label to ship the Giveaway prize(s).
5933Transactions created as the result of a Giveaway are binding.
5934After the Posh Show ends, any orders, including Giveaway winnings, will be automatically processed.
5935Host(s) must comply with the terms of the Giveaway unless the order is canceled by Poshmark.
5936Host(s) may not change the Giveaway prize after a winner is randomly selected.
5937Repeat instances of unfulfilled Giveaways may result in account restrictions.
5938Entrants to the sweepstakes may not use multiple accounts or automated methods to enter Giveaways.
5939Giveaway abuse may result in account restrictions without notice.
5940Poshmark reserves the right to cancel Giveaway prizes or limit access to participating in Shows in our sole discretion.
5941If you suspect someone is abusing Giveaways, please contact us .
5942Additional Host and Seller Rules Posh Show Hosts and Sellers agree to these additional rules: Hosts must be 18 years of age or older.
5943Hosts must be engaged with their own Posh Show by actively auctioning items or facilitating discussions related to selling on Poshmark.
5944Hosts must appropriately designate whether their Posh Show is a “Live Show” or a “Silent Show.” Live Shows are Posh Shows where Hosts are actively engaging with viewer(s) through camera and the audio or chat features.
5945Please note that in order to be a Live Show, relevant content, such as the Host, merchandise, or activities related to merchandising or selling on Poshmark, must remain on camera.
5946Posh Shows that primarily will not incorporate such relevant video content should be designated as a Silent Show.
5947Poshmark reserves the right to determine, at its sole discretion, whether a Posh Show has been appropriately designated as a Live Show or Silent Show.
5948Except as specified above in the “Promotions”’ section, Posh Shows may not be used to post any content that constitutes a raffle, contest, sweepstakes, or giveaways involving pure luck or chance.
5949Qualifying mystery listings are subject to additional requirements in order to be eligible for Seller protection.

5951Hosts must not engage in or promote unsafe activities during Posh Shows.
5952In addition, Hosts must be aware and respectful of their surroundings, especially when hosting from public or shared spaces.
5953Hosts and Sellers must not perform any activity that could be considered manipulating the bid price of an auction, including spoofing, shilling, or enlisting secondary or additional accounts to drive up the price.
5954Miscellaneous Poshmark reserves the right to stop or cancel any Posh Show without prior notice for any reason, including due to a violation of any of Poshmark terms or policies.
5955If you are a Seller, you must describe your items truthfully, accurately, and completely during the Posh Show and promptly ship the items sold during the Posh Show, in accordance with the Terms of Service.
5956If you are a Buyer, you are responsible for reviewing the item before making a bid or purchasing.
5957As indicated in the Poshmark Terms of Service, Buyers and Sellers enter into a contract for the sale and purchase of items directly between themselves, and Poshmark is not an auctioneer or a party to such sale or purchase.
5958Please note that the Poshmark Terms of Service include provisions on dispute resolution.
