2Our services include: (1) the content on our website located at https://www.binance.us/ (“ Website ”) or any other websites, pages, features, or content we own or operate (collectively, the “ Sites ”) or when you use our mobile app; (2) any application program interface (“ API ”) made available by BAM to you as a service or third-party applications relying on such an API (“ BAM APIs ”); (3) the Platform (defined below) which provides Digital Asset (defined below) trading services (“ Trading Services ”); (4) staking, through third parties or otherwise, of Digital Assets that you may designate (“ Staking Services ”) by BAM or entities undertaking Staking Services on BAM's behalf; and (5) any other services that BAM may make available, directly or indirectly, from time-to-time (collectively, the “ Services ”).2Our services include: (1) the content on our website located at https://www.binance.us/ (“ Website ”) or any other websites, pages, features, or content we own or operate (collectively, the “ Sites ”) or when you use our mobile app; (2) any application program interface (“ API ”) made available by BAM to you as a service or third-party applications relying on such an API (“ BAM APIs ”); (3) the Platform (defined below) which provides Digital Asset (defined below) trading services (“ Trading Services ”); (4) staking, through third parties or otherwise, of Digital Assets by BAM or entities undertaking Staking Services on BAM's behalf; and (5) any other services that BAM may make available, directly or indirectly, from time-to-time (collectively, the “ Services ”).

5If you use the Services after the Soft-Staking Launch Date (defined below), you are directing BAM to stake the assets you provide in connection with Soft-Staking (defined and described below).
15Notwithstanding the foregoing, starting July 1, 2026, we will provide you with at least fourteen (14) days’ prior notice of any changes to our fee schedule, these Terms, or any policies applicable to your Account that have a material impact on digital financial asset business activity with you, to the extent required by applicable law.
28You understand that BAM Trading is under common ownership with companies that have made investments in a broad range of digital asset projects, including some Digital Assets listed on our exchange.30You understand that BAM Trading is under common ownership with companies that have made/may make investments in a broad range of digital asset projects, including some Digital Assets listed on our exchange.
51If you designate eligible Digital Assets for the Staking Services, BAM may stake the designated Digital Assets by storing such Digital Assets with a third-party staking custody provider ( “Staking Custody Provider” ), and then staking the designated Digital Assets with a third-party staking services provider ( “Staking Services Provider” ).53If you designate eligible Digital Assets for the Staking Services, BAM may stake the designated Digital Assets by storing such Digital Assets with one or more third-party staking custody provider ( “Staking Custody Provider” ), and then staking the designated Digital Assets with one or more third-party staking services provider ( “Staking Services Provider” ).
52If the Staking Services Provider successfully validates a block of transactions in a particular Digital Asset, you may earn a reward granted by that Digital Asset’s network.54If the Staking Services Provider(s) successfully validate(s) a block of transactions in a particular Digital Asset, you may earn a reward granted by that Digital Asset’s network.
55You are not required to stake Eligible Tokens with BAM to maintain an Account(s) or use our Services.57Unless expressly stated elsewhere in these Terms or on the Sites, BAM will automatically enroll and stake ( “Soft-Staking” ) certain Eligible Tokens held in your Account that are not already enrolled in the Staking Services ( “Soft-Stake Tokens” ).
58As additional Eligible Tokens are also included as Soft-Stake Tokens, BAM will automatically enroll and stake those Digital Assets in Soft-Staking.

60BAM reserves sole and absolute discretion to modify the list of Eligible Tokens and Soft-Stake Tokens.
57Notwithstanding anything herein to the contrary, or which entity has custody of the Eligible Tokens, you retain ownership of such Eligible Tokens and such Eligible Tokens shall remain your property when staked under the terms of this Agreement, however, the Eligible Tokens designated for the Staking Services will not be available for use (i.e., not available for sale or transfer) during your participation in the Staking Services (further details provided below).62Notwithstanding anything herein to the contrary, or which entity has custody of the Eligible Tokens, you retain ownership of such Eligible Tokens.

84You also authorize BAM to unstake your assets at any time if your eligibility status changes.

107Soft-Staking .
108Following the date Soft-Staking is launched ( “Soft-Staking Launch Date” ), BAM will automatically enroll and stake Soft-Stake Tokens held in your Account, and not already enrolled in the Staking Services, in Soft-Staking.
109If you become a user on or after the Soft-Staking Launch Date, your affirmative acceptance of these Terms constitutes your express consent to participate in Soft-Staking and your authorization for BAM to enroll Soft-Stake Tokens held by you on the Platform into Soft-Staking.
110If you are an existing user prior to the Soft-Staking Launch Date, you have a period from the Soft-Staking Launch Date ( “Opt-Out Period” ) to opt-out of Soft-Staking.
111Following the Opt-Out Period, all existing users will automatically be enrolled in Soft-Staking.
112For existing users, your affirmative acceptance of the consent screen constitutes your express consent to participate in Soft-Staking and your authorization for BAM to enroll Soft-Stake Tokens held by you on the Platform into Soft-Staking.
113You also authorize BAM to remove your Soft-Stake Tokens from Soft-Staking at any time if your eligibility status changes.
114BAM, the Staking Custody Providers, and the Staking Services Providers are not liable or responsible for any consequences if your assets are removed from Soft-Staking for any reason whatsoever.

116If your Eligible Tokens are staked via Soft-Staking, you retain ownership of each Soft-Stake Token.
117The Staking Services terms will also apply to the Soft-Stake Tokens.
118However, in the event of any conflict or inconsistency between the Soft-Staking terms and the Staking Services terms, the Soft-Staking terms shall control solely to the extent of such conflict.
119Soft-Stake Tokens shall be eligible for Staking Rewards.
120The reward for staking Soft-Stake Tokens will be determined by the Soft-Stake Token protocols and subject to BAM’s Soft-Staking service fee.
121The current Soft-Staking service fee can be found on the Fees page and is subject to change at BAM’s sole discretion.
122Any change in the fee will be posted on the website with immediate effect unless stated otherwise.
123BAM does not decide whether, when or how much of your Eligible Tokens to enroll in Soft-Staking.
124BAM only determines the Staking Custody Provider and Staking Service Provider.
125At any point during your use of the Sites, you may choose not to use Soft-Staking by utilizing the Staking Services or removing all Soft-Stake Tokens from your Account.
126In connection with its administrative responsibilities, BAM will seek to avoid slashing penalties.
127In the unlikely event Soft-Staking incurs a slashing penalty, BAM will reimburse or indemnify your Account for any resulting loss.
128BAM may limit eligibility for Soft-Staking to jurisdictions, based on state and local law, or otherwise at BAM's sole discretion.
129Similarly, BAM may modify or discontinue Soft-Staking at any time and for any reason whatsoever.

132From time to time, BAM may also provide an option to eligible users in eligible states holding certain Digital Assets to participate in certain Boost Promotions.

134One Click Multi Buy (“OCMB” or “Bundles”) .
135From time to time, BAM may make available a OCMB or Bundle feature, that allows users to simultaneously purchase multiple Digital Assets.
136Use of the OCMB or Bundles feature subject to such terms and conditions as may be established by BAM from time to time which are published here and incorporated into these Terms.

333In certain cases, BAM may support users to claim certain “Opt-In Rewards,” including Airdrops or other rewards automatically distributed or available to certain holders of Digital Assets on certain networks.
334Receipt of such Opt-In Rewards does not depend on participation as a validator in a consensus protocol.
335BAM may cease supporting users to claim Opt-In Rewards at any time in its discretion.
541As you continue to use the Services, we may seek additional information required towards ongoing security, fraud prevention and sanctions program compliance on the platform.
501You acknowledge and agree that: (1) BAM is not holding any fiat monies and/or Digital Assets as your trustee, and is not acting as your broker, futures commission merchant, intermediary, agent, trustee, advisor or in any fiduciary capacity; and (2) no communication or information provided to you by us shall be considered or construed as any form of advice.548You acknowledge and agree that: (1) BAM is not holding any fiat monies and/or Digital Assets as your trustee, and is not acting as your broker, futures commission merchant, intermediary (subject to the “Financial Asset Election” section, above, with regard to UCC Division 8), agent, trustee, advisor or in any fiduciary capacity; and (2) no communication or information provided to you by us shall be considered or construed as any form of advice.
