No Sale of Personal Data

Low severity

Why it matters

While Anthropic does not sell data in the traditional sense, sharing data for targeted advertising may still constitute a 'sale' under some state privacy laws, meaning users may have opt-out rights they are not fully informed about.

Consumer impact

Anthropic collects your conversation inputs and outputs, device data, and usage information, and may use that data to train its AI models unless you opt out. Even after opting out, Anthropic retains the right to use your conversations for training if they are flagged for safety review. You can opt out of having your conversations used for model training by adjusting your account settings at claude.ai.

Applicable agencies

  • State AG
California's Attorney General enforces CCPA/CPRA, which defines 'sale' broadly to include sharing for advertising and grants consumers the right to opt out.
