Unilateral Right to Modify Terms

Medium severity
Share 𝕏 Share in Share

Why it matters

You could be bound by significantly different terms — including new fees, data practices, or dispute resolution rules — without receiving direct personal notice, simply by continuing to use the app.

Consumer impact

Poshmark's terms impose a 20% commission on all sales over $15 and grant the platform a permanent, irrevocable license to use seller-submitted photos and content for commercial purposes. Sellers and buyers are required to resolve all disputes through binding individual arbitration, waiving the right to participate in class action lawsuits, which significantly limits collective legal recourse in the event of systemic platform issues. You can opt out of the arbitration clause by sending written notice to Poshmark within 30 days of first accepting the Terms of Service.

Applicable agencies

  • FTC
The FTC can investigate whether unilateral modification of material terms without direct consumer notice constitutes an unfair or deceptive act or practice under Section 5.
    File a complaint →
  • State AG
State Attorneys General, particularly in California, have authority to pursue unfair contract modification practices under state consumer protection statutes including the CLRA.
