| | | stories, participate in a Posh Show, make purchases, search for items, and comme |
| | | nt or otherwise interact with listings, closets, or other users. This includes a |
| | | ny pictures, video and audio clips, closet descriptions, search terms, informati |
| | | on about items you have listed, sold, or purchased, and any interaction with use |
| | | rs and listings, such as likes, comments, replies, and offers.When you buy and s |
| | | ell on Poshmark, we will need to collect payment and billing information, such a |
| | | s credit card and bank account information to complete the transaction. |
| | | Information You Provide through Our Support Channels: We collect information whe |
| | | n you contact Poshmark and our customer support for any reason, such as asking q |
| | | uestions and sharing feedback, issues, or problems. You may be asked to provide |
| | | contact information, a summary of the problem you are experiencing, and any othe |
| | | r documentation, screenshots or information that would be helpful in resolving a |

| | | Information You Provide when Verifying Your Identity: Identity verification may |
| | | be required for fraud prevention and compliance purposes. We may collect certain |
| | | identification information, such as driver’s license information, date of birth |
| | | , social security number, and passport number to verify your identity. We may al |

| | | witter, Instagram, Pinterest, or Snapchat. If you choose to connect your social |
| | | media accounts to our Services, we may collect information about you from these |
| | | accounts, such as username, friend or following lists, and other profile informa |

| | | Information Obtained from Other Third Parties: We may obtain information, such a |
| | | s demographics, from other third parties like commercial data brokers or aggrega |

| | | Information about Others: Prior to sharing any information about others for any |
| | | purpose through the Service, you must satisfy any consents or other applicable l |
| | | egal and regulatory requirements. This includes, but is not limited to, the info |

| | | not limited to profile information, search, likes, and purchase histories, to s |
| | | uggest items, closets, offers, features, or events that we think you might enjoy |

| | | ring your visit or the next time you visit the site and to provide custom, perso |

| | | pping and delivery partners. If you participate in the Poshmark Consignment Netw |

| | | ments, and other news about relevant features and aspects of our Services. For e |
| | | xample, we may send you communications responding to customer support questions, |
| | | providing information about transactions, or notifying about user engagement. Y |
| | | ou may adjust your email and push notification preferences through our app or we |
| | | bsite, or follow any opt-out instructions provided with the communication (e.g. |

| | | gating suspicious activity, identifying and prevent fraud, preventing the sale o |
| | | f counterfeit items, verifying your identity, and fulfilling anti-money launderi |
| | | ng and know-your-customer obligations. We and our fraud vendors, such as LexisNe |
| | | xis Risk Solutions and Sift Science, may use information such as name, address, |
| | | email, general location information, IP address, device data (e.g., operating sy |
| | | stem, version, model, identifiers, etc.), the content you post, and your use of |
| | | the Services to verify accounts and activity, and to monitor suspicious or fraud |
| | | ulent activity. |

| | | Provide, develop, analyze, and improve the Services. We use the information we c |
| | | ollect to provide, develop, analyze, and improve the Services. This includes res |
| | | earch and development and the creation and testing of new and existing features, |
| | | which may involve analyzing your usage of our Services and creating anonymous a |

| | | cable rights or choices you may have exercised, this may include providing you w |

| | | reorganization, divestiture, dissolution, or liquidation), or other business tra |

| | | ial media accounts to your Poshmark account and direct us to share your listings |

| | | In addition, please note that we are not responsible for the personal data you c |
| | | hoose to submit on pages and content accessible to the general public, including |
| | | but not limited to, your profile, closet, listings (including any “Meet the Pos |
| | | her” listings), photos, comments (including on our blog), love notes, Posh Stori |
| | | es, or Posh Shows. Once displayed on a publicly accessible location, that inform |
| | | ation can be collected, used, and shared by the public at large both on and off |
| | | our Services (e.g. a listing could be shared to social media). |
| | | 5. How We Store and Maintain the Information We Collect |
| | | The information we obtain will be retained to provide the Services to you and to |
| | | fulfill the business and commercial purposes for which they are collected or as |
| | | needed to satisfy applicable governmental laws, regulations, investigations, pr |
| | | oceedings or for reasonable backup, archival, audit, legal, tax, accounting, com |
| | | pliance, or other similar purposes. For example, requirements related to financi |
| | | al transactions and anti-money laundering purposes often require us to keep cert |
| | | ain information for 7 years but may vary depending on your location. |

| | | Poshmark employs organizational, technical, and physical safeguards intended to |
| | | protect personal data from loss, misuse, and unauthorized access, disclosure, al |
| | | teration, or destruction. Depending on the circumstances, our safeguards to prot |
| | | ect personal data may include facilities access restrictions, system access cont |
| | | rols, firewalls, data encryption, and other security best practices. |

| | | ou send to us in this way. Your information may be stored with third-party cloud |

| | | Posh Show Policy |
| | | All users must follow our Community Guidelines, Terms of Service, and other poli |
| | | cies when participating in a Posh LIVE Show ("Posh Show"), including buying and |
| | | selling. Select Sellers can create and schedule Posh Shows, as well as join othe |
| | | r Sellers’ Posh Shows as co-hosts (collectively, “Hosts”). Poshmark has sole dis |
| | | cretion to determine user eligibility to host or participate in Posh Shows. As s |
| | | et forth in our Terms of Service, you are solely responsible for any activity th |
| | | at occurs through your Poshmark account and all content you transmit or submit t |
| | | hrough Poshmark, including any live content from Posh Shows. |
| | | Auctions |
| | | During a Posh Show, the Host may choose to start an auction. Whether you are a B |
| | | uyer or a Seller, when you participate in an auction, you understand and agree a |
| | | s follows: |
| | | Sellers set the starting price. If you are a Seller, please be sure to set the s |
| | | tarting price that reflects a comfortable sale price for you. Once an auction ha |
| | | s started, it cannot be canceled, and the starting price cannot be adjusted. Sel |
| | | lers are not permitted to bid on their own item or to ask others to bid up the p |
| | | rices on an item. |
| | | All bids are final and binding. If you are the highest bidder when an auction co |
| | | ncludes, your payment method will be charged for the winning bid amount, plus an |
| | | y shipping, taxes, or additional fees listed. Please note: |
| | | There may be instances in which two users enter the same bid amount at nearly th |
| | | e same time. In this case, if your username is not displayed as the highest bidd |
| | | er, then your bid was not accepted, and you will need to submit a new, higher bi |
| | | d if you would like the item. |
| | | Poshmark is not responsible for technical issues, including disconnection from t |
| | | he platform, while buying or selling. Bids entered and accepted prior to a loss |
| | | of connection will be considered binding. |
| | | Buy Now |
| | | Hosts may enable Buy Now on certain listings during a Posh Show. |
| | | Once Buy Now is enabled, Buyers will be able to purchase the featured listing di |
| | | rectly in the Posh Show at the price indicated. Buy Now will be enabled until th |
| | | e listing is sold out, or until the host stops Buy Now or features another listi |
| | | ng. |
| | | All Buy Now purchases in a Posh Show are final and binding. |
| | | Promotions |
| | | As a Host, if you choose to use the Service to administer or communicate a promo |
| | | tion (i.e. sweepstakes or contest) during a Posh Show, you are responsible for t |
| | | he operation of that promotion in accordance with our Terms of Service, our Priv |
| | | acy Policy, and any applicable laws, including the following: |
| | | Offer terms and eligibility requirements (e.g. age and residency) |
| | | Official rules that include all disclosures required by applicable laws and regu |
| | | lations and that include: |
| | | A complete release of Poshmark by each entrant or participant; and |
| | | A statement acknowledging that the promotion is in no way associated with or spo |
| | | nsored, enforced, or administered by Poshmark; and |
| | | Compliant with applicable laws and regulations governing the promotion and the p |
| | | rizes (e.g. registration requirements). |
| | | Poshmark will not assist in the administration of giveaways offered outside of t |
| | | he "Giveaways" feature (each, a "Giveaway"), and you agree that if you use the S |
| | | ervice to administer your promotion, you do so at your own risk. |
| | | Where Host(s) conducts a sweepstakes as part of a Posh Show, the following addit |
| | | ionally applies: |
| | | Prizes offered for a chance to win and randomly awarded via the "Giveaways" feat |
| | | ure will not be considered by Poshmark to have a cash value and are not consider |
| | | ed purchases, and any transaction(s) that consist of such item(s) are not eligib |
| | | le for refund via Posh Protect. Hosts and prize winners are responsible for the |
| | | reporting and payment of any and all prize related taxes and expenses, respectiv |
| | | ely, where applicable. |
| | | Prizes offered via the "Giveaways" feature must adhere to selling guidelines. Ho |
| | | st(s) are not allowed to give away prohibited or otherwise unsupported items, su |
| | | ch as replicas, perfume, nail polish, or non-Poshmark gift cards. |
| | | Poshmark gift card prizes cannot be used for purchases made within the same Posh |
| | | Show and hold no cash value. All Poshmark gift card prizes, whether a physical |
| | | gift card or a printed version of a virtual gift card, must be shipped to the wi |
| | | nner using Poshmark’s provided shipping label. |
| | | The listing for the Giveaways prize must be categorized appropriately (e.g., if |
| | | the prize is an electronics item, the listing must be categorized as such). |
| | | Hosts are responsible for the costs of shipping Giveaway prize(s). Shipping cost |
| | | s will be automatically deducted from the Host's earnings. Any additional items |
| | | purchased by the Giveaway winner during the same Posh Show will be bundled and s |
| | | hipped with the Giveaway prize(s). If the total weight of the bundle (including |
| | | the Giveaway prize(s)) is over 5 pounds, the Host must pay to upgrade the shippi |
| | | ng label. Hosts must use the Poshmark-provided shipping label to ship the Giveaw |
| | | ay prize(s). |
| | | Transactions created as the result of a Giveaway are binding. After the Posh Sho |
| | | w ends, any orders, including Giveaway winnings, will be automatically processed |
| | | . Host(s) must comply with the terms of the Giveaway unless the order is cancele |
| | | d by Poshmark. Host(s) may not change the Giveaway prize after a winner is rando |
| | | mly selected. Repeat instances of unfulfilled Giveaways may result in account re |
| | | strictions. |
| | | Entrants to the sweepstakes may not use multiple accounts or automated methods t |
| | | o enter Giveaways. Giveaway abuse may result in account restrictions without not |
| | | ice. Poshmark reserves the right to cancel Giveaway prizes or limit access to pa |
| | | rticipating in Shows in our sole discretion. If you suspect someone is abusing G |
| | | iveaways, please contact us. |
| | | Additional Host and Seller Rules |
| | | Posh Show Hosts and Sellers agree to these additional rules: |
| | | Hosts must be 18 years of age or older. |
| | | Hosts must be engaged with their own Posh Show by actively auctioning items or f |
| | | acilitating discussions related to selling on Poshmark. |
| | | Hosts must appropriately designate whether their Posh Show is a “Live Show” or a |
| | | “Silent Show.” |
| | | Live Shows are Posh Shows where Hosts are actively engaging with viewer(s) throu |
| | | gh camera and the audio or chat features. Please note that in order to be a Live |
| | | Show, relevant content, such as the Host, merchandise, or activities related to |
| | | merchandising or selling on Poshmark, must remain on camera. |
| | | Posh Shows that primarily will not incorporate such relevant video content shoul |
| | | d be designated as a Silent Show. Poshmark reserves the right to determine, at i |
| | | ts sole discretion, whether a Posh Show has been appropriately designated as a L |
| | | ive Show or Silent Show. |
| | | Except as specified above in the “Promotions”’ section, Posh Shows may not be us |
| | | ed to post any content that constitutes a raffle, contest, sweepstakes, or givea |
| | | ways involving pure luck or chance. |
| | | Qualifying mystery listings are subject to additional requirements in order to b |
| | | e eligible for Seller protection. See our Prohibited Items Policy for details. |
| | | Hosts must not engage in or promote unsafe activities during Posh Shows. In addi |
| | | tion, Hosts must be aware and respectful of their surroundings, especially when |
| | | hosting from public or shared spaces. |
| | | Hosts and Sellers must not perform any activity that could be considered manipul |
| | | ating the bid price of an auction, including spoofing, shilling, or enlisting se |
| | | condary or additional accounts to drive up the price. |
| | | Miscellaneous |
| | | Poshmark reserves the right to stop or cancel any Posh Show without prior notice |
| | | for any reason, including due to a violation of any of Poshmark terms or polici |
| | | es. If you are a Seller, you must describe your items truthfully, accurately, an |
| | | d completely during the Posh Show and promptly ship the items sold during the Po |
| | | sh Show, in accordance with the Terms of Service. If you are a Buyer, you are re |
| | | sponsible for reviewing the item before making a bid or purchasing. |
| | | As indicated in the Poshmark Terms of Service, Buyers and Sellers enter into a c |
| | | ontract for the sale and purchase of items directly between themselves, and Posh |
| | | mark is not an auctioneer or a party to such sale or purchase. Please note that |
| | | the Poshmark Terms of Service include provisions on dispute resolution. If you d |
| | | o not agree with this Posh Show Policy (as may be updated from time to time), pl |
